Section 164 of the Highways Act 1980 states that barbed wire on land adjoining a public highway must not cause a nuisance or present a danger to humans or animals using that highway. A public right of way counts as a highway. At various points in and around Verney Fields barbed wire is wrapped around posts and gates. This clearly poses a risk of injury and is unlawful. It is especially a hazard as the footpaths in wet weather become a muddy quagmire & the new steep steps make a trip or fall more likely. The GCC footpath officer has confirmed to me that she has asked the landowner to remove such barbed wire m, but last time I checked it was still wrapped around posts and gates at various points. There is also a common law offence of public nuisance. Barbed wire adjacent to a footpath could be considered to be a 'public nuisance', especially where the path is narrow. A walker who is injured or damages their clothes on barbed wire when using the path could claim for damages against the landowner. GCC need to ensure the law is complied with., 9th May
